According to TMZ, Nicollette has dropped her claims of discrimination and harassment based on sex, age and sexual orientation. But the case is not over, with claims of assault and battery and wrongful termination still on.
However, I know this and the previous stipulation have been submited to court by the defendants’s attorney and not Nicollette’s. Have these matters been resolved in private?

Different publications report Nicollette dropped the most explosive claim on her lawsuit against Marc Cherry and ABC. The stipulation filed Friday, Nicollette retracts her claim for intentional infliction of emotional disgress and won’t assert any claim for emotion or physical damages; the defense won’t make her undergo mental or physical examination.
Nicollette, who sued over alleged assault and battery, wrongful termination and sex and gender discrimination will proceed with the case pursuing lost wages, benefits and financial conmpensations. Sheridan states in the new papers that while those claims are still valid, she is removing them to streamline the case. The defense agreed and the case will move forward as planned.
Somehow I think this is a bad move for Nicollette as a lot of people will think she was lying (which I don’t, remember September 2008 and all the rumors online about her being slapped on set) but at the same time it’s good for both sides as it’ll be a hard point to prove for any of them. I do see a case for wrongful termination. I think going back to interviews in 2004 anyone could see how different, and sometimes disrespectfully, Marc Cherry talks about Nicollette; how her exit from the show was rushed and only lasted 2 episodes: 5.18 and 5.19; and for budget reasons: 6 different actors were hired full time the following season.
We haven’t heard the end of this and if the case goes to court as planned, we’ll have to wait a little longer.
UPDATE: As you know, all reports claim that Nicollette filed an amend on Friday, whoever I can’t find any track of that but an stipulation and order (about that issue) filed by the Defendant this Monday. As Linda Sharps from The Stir says, if he was truly innocent would the defense be so eager to drop their demands? She also asks why Nicollette did it, if it was difficult to prove any emotional or physical damages after all this time or if it’ll cause her more distress.

As you know, one of Nicollette’s co-stars on her new movie is Irish actresss Victoria Smurfit and ever since filming started the press in Ireland have been talking about how they get along. Victoria now has talked about Nicollette and their friendship.
“She’s a lovely woman and we had great fun together,” Victoria said. “We got to do a lot of yoga together.”
Victoria also said they want to keep everything about the movie under wraps but revealed she plays an American.

Here are some articles about the latest development on Nicollette’s lawsuit against Marc Cherry and ABC. To make long story short, ABC wanted to get parts of the suit dismissed (or get clarifications) and judge denied their request giving Nicollette the go ahead on the lawsuit.
Which on my opinion, comes to say there might be some true on her words for the judge to allow it.
Nicollette Sheridan has been granted permission to sue the creator of ‘Desperate Housewives’.
The actress was told by Los Angeles Superior Court Judge Elizabeth Allen White yesterday (07.09.10) that the case she filed in April 2010 accusing Marc Cherry and network ABC of alleged assault and battery, gender violence, wrongful termination and discrimination based on sex, sexual orientation and age following her axe from the show in September 2008 is valid.
Lawyers for the network argued against the discrimination aspect of the suit, insisting it provided an uncertain cause of action because it combined three separate claims.
However, the judge said: “Although annoying, inconvenient and inconsiderate, the failure to separate the three distinct wrongs does not result in an inability to understand what is alleged.”
She also denied ABC’s request to have some language relating to the alleged harassment from the complaint removed.
The network’s lawyer Adam Levin told the judge both parties had not agreed to mediation, meaning the dispute may now be played out in open court.
In her suit, Nicollette – who is suing for $20 million damages – claimed Marc hit her across the face and sacked her when she complained to network ABC.
The case was originally filed in April, though a month later, the actress made an amendment to say he had given her a “light tap” on the face.
The updated lawsuit states: “In December 2008, Sheridan was informed that ABC had fully investigated her complaint and had concluded that she was not mistreated. In fact, the Executive Vice President of ABC Studios, Howard Davine, claimed that ‘Marc Cherry simply gave her a light tap on the side of her head for the sole purpose of providing direction for a scene they were rehearsing.’ With that, ABC decided to take no further action and closed the investigation, informing Sheridan that ‘we will finish off the season in the spirit of professionalism and courtesy that has been the normal course for ‘Desperate Housewives’.’
“However, rather than a season of ‘professionalism and courtesy’, Sheridan was informed in February 2009 that her employment on the show was going to be terminated and that her character, Edie Britt, was being killed off the show.”
At this point, it claims Nicollette was ordered to “break the story” she would be leaving to the press.
Nicollette Sheridan can move forward with her $20 million suit alleging “Desperate Housewives” creator Marc Cherry assaulted, then fired her, because she disagreed with a script, a judge ruled today.
Los Angeles Superior Court Judge Elizabeth Allen White denied a motion by Cherry’s attorney, Adam Levin, to compel Sheridan’s lawyers to clarify the discrimination portion of her complaint, so he can adequately respond to it.
“I agree with you. It’s not a model of clarity,” White said, adding that she would not be surprised if Levin brought another motion to dismiss part or all of the case.
Sheridan, 46, filed her suit April 5 against Cherry, ABC and Touchstone Television Products. She alleges Cherry struck her across the head and face on the set, then fired her when she complained about the incident.
Levin maintained that Sheridan’s suit improperly merges separate allegations of discrimination based on age, sex and sexual orientation into one. Sheridan is heterosexual, and Cherry is gay, according to the complaint.
“The complaint is shrouded in mystery,” Levin said. “The defendants don’t know what they need to respond to.”
Sheridan played Edie Britt on 112 episodes of the hit show.

FIDO Friendly: Tell us about your role as spokesperson for National Guide Dog Month and how did you become involved?
Nicollette Sheridan: Natural Balance is a company that I believe in. I love their organic kibble and so does my very finicky dog, Oliver. They are people who truly care about animals and have huge hearts. When it was brought to my attention that Natural Balance, PETCO and independent pet stores were raising money to help the blind with gifting these incredibly smart and loving dogs to comfort and guide them through their lives—I couldn’t wait to help in any way I could. Guide Dogs of the Desert is a wonderful organization that provides all services to the blind at no charge. I had the privilege of spending time with them and working with their puppies and grown guide dogs. The money being raised in the month of September will enable Guide Dogs of the Desert and all guide dog schools across the country to help raise many more dogs in their programs that will help give the “miracle of independence” to so many more people in need. Every PETCO across the country is participating. When you make a purchase at PETCO or a participating independent pet store near you—you can round up your payment and every penny will go to aiding a blind person in need. Or you can simply make a donation. Quality of life is something we all deserve so let’s make a difference and help the blind find their way.

I’m still sorting out all the Nicollette related news that came out this week I was absent (I knew that will happen), so my posts might be not in date order.

Imagine living without sight, relying solely on your other senses — and trusting others — to find your way. It’s a reality for many people, but one that can be aided with the help of a guide dog.
To celebrate these special animals, actress Nicollette Sheridan has teamed up with PETCO and Natural Balance Pet Foods to raise money for National Guide Dog Awareness Month, which runs through the end of September. For every specially marked bag of Natural Balance purchased at a PETCO or participating retailer, one dollar will be donated to guide dog charities. (You can make an additional donation of any size at PETCO as well.) The goal is to raise $1 million by the end of the month.
“I just thought this was such a special, wonderful way to help out,” Sheridan tells PEOPLEPets.com. “To be able to give somebody the gift of guidance through life with a furry companion that is just filled with love and compassion and kindness, that’s a really beautiful thing.”
In recent weeks, Sheridan has met with guide-dog trainers, learning about the work they do and the tasks it takes to turn a puppy into a seeing-eye dog. “Those dogs are incredibly bright and highly intuitive,” she says. “But it takes two years to train the puppies, and a total of $40,000. A lot of people can’t afford that miracle of independence.”
Many of the charities involved — like Guide Dogs for the Blind and Guide Dogs of America — give dogs to the visually impaired free of charge. “We need to urge others to help change these peoples’ lives,” she says.
For her part, Sheridan brings her 5-year-old golden retriever, Oliver, to retirement homes, where he “puts smiles on so many faces,” she says. “He’s a character, and full of personality. He comes everywhere with me.”

Saturday night brings new meaning to Dodger dogs
The event sold out with 500dogs packing the right-field pavilion, having just as much right to sit there since their owners paid $25 per all-you-can-eat ticket for them, too. German shepherds and dachshunds and poodles and shaking Chihuahuas were invited guests for one game.

Saturday was the first time the Dodgers hosted “Bark in the Park” an event in which fans brought their dogs to the game, provided they had updated records of shots. This was all unbeknownst to that security guard.
The event went off with plenty of barks, licks and accidents on the warning track, but it was quite an event, especially since some of the proceeds were being donated by the Dodgers to the Society for the Prevention of Cruelty to Animals in Los Angeles.
The Dodgers partnered with Dick Van Patten’s Natural Balance Pet Foods and Tillman the skateboarding bulldog.
They did the event with the Mets in New York and the Rangers in Texas, too.
“We’re certainly planning on doing it again,” Dodgers spokesman Josh Rawitch said. “Nothing happened that would make us not do it again. It was well-received by fans. It attracted a lot of media. It was a fun story. Enough people said, `I’ve always wanted you guys to do this.”‘

Nicollette Sheridan, who starred on “Desperate Housewives,” cooed while she fed her dog, Oliver, a Dodger dog. The Dodgers hit four home runs, and Oliver – a 5-year-old Golden retriever – calmly sat in the row behind while Sheridan stood and cheered.
“We should’ve had Bark in the Park at the beginning of the season,” Sheridan said, laughing.

Today I have to ask you something. The idea of making a joint donation in name of Nicollette to any charity close to her heart has always been on my mind, but I needed to know what charity she was fully collaborating with. Since right now she has partnered with Natural Balance to support different Guide Dogs organizations across the USA, I think this is a great time to do it and show her our support as fans.
